Exposure Assessment

We conduct detailed exposure assessments to quantify worker and environmental exposures to hazardous substances. This includes the design and execution of sampling strategies, personal and area air monitoring, bulk and surface sampling, and data interpretation. Our assessments are tailored to the specific exposure scenario, taking into account work practices, environmental conditions, and potential exposure pathways. Results are evaluated against applicable occupational exposure limits and guidelines, with clear recommendations provided to manage or mitigate identified risks.

Exposure Modeling

OEH Solutions utilizes advanced exposure modeling techniques to estimate exposures in situations where direct measurement is limited, unavailable, or requires supplementation. We literally wrote the book titled Mathematical Models for Estimating Occupational Exposure to Chemicals. Potential modeling includes retrospective exposure reconstruction, predictive modeling for proposed operations, and scenario-based risk evaluations. We apply validated models and defensible assumptions to estimate airborne concentrations, dose, and exposure variability. These analyses are particularly valuable in litigation,
regulatory review, and long-term risk assessment, where historical or hypothetical exposure conditions must be evaluated with scientific rigor.

OSHA Employer Liability

OEH Solutions provides detailed analyses of employer liability under OSHA regulations in both enforcement and litigation contexts. Our work evaluates whether an employer’s safety programs, hazard recognition practices, and field-level implementation meet applicable OSHA standards and the General Duty Clause. Drawing on extensive experience as former OSHA Compliance officers, we incorporate enforcement frameworks and interpretive guidance routinely used in inspections and citation development, including Compliance Policy Instructions (CPLs), the Field Operations Manual (FOM), and Letters of Interpretation.

A key component of our analysis involves the multi-employer worksite doctrine, which frequently governs citation issuance and liability allocation in construction, industrial, and complex operational environments. We assess employer roles as creating, exposing, controlling, or correcting parties and evaluate how these classifications influence OSHA citation exposure and shared responsibility. This framework is also critical in premises liability litigation, where overlapping contractor, subcontractor, and site owner responsibilities can significantly impact determinations of duty, knowledge, and control. Our evaluations provide clear, defensible opinions on how OSHA enforcement principles translate into real-world liability exposure across multi-party worksites.
